By accessing or using Tenant Scan's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Description of Service
Tenant Scan provides tenant screening services that generate consumer reports for landlords to evaluate rental applications. Our services include:
- Identity verification
- Income and employment verification through secure financial data access (via Plaid)
- Rental payment history analysis
- Background checks (criminal history, eviction records)
- Risk assessment and fraud detection
3. User Eligibility
You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are of legal age to form a binding contract.
4. User Accounts and Responsibilities
For Tenants:
- You are responsible for providing accurate and complete information
- You authorize us to access your financial information through Plaid for screening purposes
- You have the right to review your consumer report before it is shared with landlords
- You have the right to approve or withdraw your application at any time before authorization
- You understand that the report provided to you is identical to the report shared with authorized landlords
For Landlords:
- You must have a permissible purpose under the FCRA to request tenant screening reports
- You must comply with all federal, state, and local fair housing laws
- You agree to use the information solely for evaluating rental applications
- You must provide adverse action notices as required by the FCRA if you deny an application based on the report
5. Data Handling and Privacy
Important Information:
- We do NOT store your detailed transaction-level financial data
- We process financial information through Plaid to generate consumer reports
- Consumer reports contain aggregated verification data, not specific transaction details
- Landlords do NOT receive access to your bank account details or specific transactions
- The report you receive is identical to the report shared with landlords you authorize

6. Authorization and Consent
By using our services, you provide your express written consent for:
- Access to your financial information through Plaid for verification purposes
- Generation of a consumer report as defined by the Fair Credit Reporting Act (FCRA)
- Sharing of the consumer report with landlords you explicitly authorize
- Use of your information for identity verification and fraud prevention
You may withdraw your consent and application at any time before authorizing report sharing with a landlord.
7. Fees and Payment
Fees for our services are clearly disclosed before you complete your application. All fees are non-refundable once a consumer report has been generated, except as required by law or at our sole discretion.

8. Accuracy of Information
While we strive to provide accurate consumer reports, we cannot guarantee the accuracy of all information obtained from third-party sources. You have the right to dispute any inaccurate information in your consumer report. See our FCRA Compliance page for dispute procedures.
9. Prohibited Uses
You agree NOT to use our services for:
- Any unlawful purpose or in violation of any applicable laws
- Discrimination based on race, color, religion, sex, national origin, disability, familial status, or any other protected class
- Fraudulent purposes or misrepresentation of identity
- Purposes other than tenant screening (for landlords)
- Unauthorized access to or use of our systems
10. Intellectual Property
All content, features, and functionality of our services are owned by Tenant Scan and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Tenant Scan shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount you paid for the service in question.
12. Indemnification
You agree to indemnify and hold harmless Tenant Scan from any claims, damages, losses, liabilities, and expenses arising from your violation of these Terms of Service or applicable laws.

Our services utilize third-party services including Plaid for financial data access. Your use of these third-party services is subject to their respective terms and conditions:

We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
15. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which Tenant Scan is registered, without regard to conflict of law principles.
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
16. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of our services after changes constitute acceptance of the modified terms.
17. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
